Is my bms dead?

I just got a dewalt dc9000 charger in & i have a free dc9360 that i got from the dewalt service centre; all cells are about the 3.3v+ mark; when i plug it in to the charger all three lights start flashing. bad bms?
 
If you are sure that ALL the cells are at 3.3V and that no one can be under 2.6V, that's definitly your BMS that is blown. Does it become hot when you plug it with the cells?

Have you tried to plug the Ac cord of the charger only with battery already placed on the charger?

The bms does not become hot at all; i've also left the battery plugged in while plugging in the charger; the same thing..
