2007 FL law cuts e-bike max speed to 10 mph!

His vehicle is legal as the law is worded.

Do not forget the section including the phrase: "scooter or scooter-like". That covers enough territory of interpretation to slam the book on Matt.

Matt will have a criminal conviction if he can't get the charge tossed or changed to a traffic infraction.

Matt. A decent local lawyer can pick up the phone and get it done in an hour. Please get a lawyer.

And get some pedals on the bike... pushing with your feet is "scooter-like".

:!:

Makes the 15mph limit here in the UK seem not so bad.

I am more worried by the change in the size of a horsepower from 746W to 750W, which one changed? or was it both?

Your honor, It doesn't have pedals because I didn't want to stray into section (77) MOPED.

Your honor most other Jurisdictions have a specific exemption to motorcycle and moped definition for a power assisted(electric) bicycle. The Fl house appears to have sloppily written this section.

Scooter scooterlike sinking him? ~~> (82) MOTORIZED SCOOTER. Any vehicle not having a seat or saddle for the use of the rider, designed to travel on not more than three wheels, and not capable of propelling the vehicle at a speed greater than 30 miles per hour on level ground.

Although Yours DOES have a seat. :) So I guess that doesn't apply. Scooters don't have seats.
This would be scooterlike. http://tbn0.google.com/images?q=tbn:SwC3HGppA6eW0M:http://www.bus-idee.nl/RotterdamSteparoundKickBike.jpg

Interesting..
the bicycle was the first reason that the roads were paved anyway
In other words these pedal-less bikes without air cushioned tires were a little rough on the family jewels so they paved the roads!

For the earliest bikes the roads were useless, mud, rutted by cart-wheel. Other than a park or estate w/groomed paths, the only place they'd work was on the boardwalks. The sidewalks.
But these boardwalks were busy with pedestrians and merchants that would set themselves up in business camping out on the sidewalks (see Chinatowns etc today.)
First harvest (folks carrying bundles of produce,) and the wheeled vehicles were banned from the boardwalks.
Cheaper to ban than to pave <smile>

Haven't read it, heard it discussed a lot.
Note the door zone bike lane on the cover page...

Said part discussing riding in the door zone:

http://www.velo.qc.ca/fr/reseau2.lasso?page=velo-securite

Translated from french:

"Precaution being important on bikes, here are the most frequent accidents which imply cyclists:

Let us take the traditional case of the door which opens in an unexpected way in front of the cyclist. How to prevent this accident? First of all, it is the motorist's responsibility to look before opening his door to make sure that the way is free: that is indicated in the rules of the road. In addition, we suggest cyclists roll one away meter from parked cars in order to give enough space to maneuver if a door would open suddenly. Do not seek to roll in vacant spaces left by cars: by adopting a regular path along parked cars, you will not surprise motorists. Moreover, you will develop, with time, a kind of vigilance which will make you locate motorists at the wheel of their parked car. Be wary of the latter and slow down when you pass to side. It is also easier to dodge a door which opens if one rolls at a normal speed for the city (between 15 and 20 km/h) rather than a faster pace. Urban displacements and those in open country do not order the same kind of behavior.[...]"

In other words: Adopt a behavior that is likely to get you involved in one of what we recognize as being the most common traffic crashes that happens to cyclists... Go real slow and try to tell if there's someone in cars you're about to pass to make up for it... And if a door does open, uh, well you're screwed I guess...
