A banned driver caught with marijuana after whizzing by on an electric bike was sentenced to 90 days in jail Wednesday.

Donald Traxler, 29, of Sarnia, had previously pleaded guilty to driving while disqualified, marijuana possession and court-order violations on July 9, 2010. He was sentenced in Sarnia court Wednesday.

Traxler was driving an electric bicycle on a sidewalk, without a helmet and at speeds of 15 to 20 kilometres per hour, when stopped by a Sarnia police officer.

A search produced 15 grams of marijuana.

Traxler was banned from driving due to three prior convictions for driving while disqualified. He was also under a court-ordered drug ban.

After serving the jail time on weekends he will be placed on probation for a year.

A further one-year driving ban was also imposed.

Reminds me of my brother in law. Now clean and sober for about 5 years, his last bust was caused by a cop pulling him over. The probobal cause for stopping him was his face, in a car driving. Every cop knew him, and his licence status. I suppose riding on the sidewalk is again the law there in Sarnia? In any case, the cops knew him as a guy who will always be holding. :lol: They'd have found a reason to empty his pockets if he'd been walking the sidewalk.

He likely was disqualified riding anything :D
 
Sounds like he was not charged for riding an electric bike while under a non-licensed status (good), but they used him riding a powered-bike on a sidewalk as "probable cause" to allow a search (busted...).

Trust me, they already knew this guy, and were taking any opportunity to randomly stop and search him. Sometimes the stop-n-search is unconstitutional, but as long as he can't find afford an expensive lawyer, he has to just put up with being hassled.

Another thing: for any of our posters who partake of herbal "glaucoma medication". Theres a fairly good chance the local authorities are watching the place you buy you medicine. Just because they don't bust the place immediately, doesn't mean they don't know. They often collect license plate numbers and descriptions of suspected buyers to assemble an informal file, because many local "patients" know each other.

If you get pulled over a month after you pick up your "prescription" ('probable-cause' being for a tail-light thats out, or a questionable lane-change) it may not be a random coincidence...

at his best (again) i.e on the podium holding the MotoGP 2011 Championship
trophy aloft as Vale looks on depressed remebring his better years
as he stands on the 2nd spot on the podium questioning his ability...
