I'm also interested to hear the response you get, I always carry a copy of the ORS that defines electric bicycles in Oregon, but I haven't ever been given a second look.

I think you are probably correct in that they see the bike from a distance and think it's got a gas motor, and this cop in particular is too full of himself to swallow that he made a mistake and instead tried to see if he could get you to screw up so he had a "reason" to pull you over.

I once talked to a local police officer here in Oregon City that just happened to be along my route parked early on and asked him what the law was on E-Bikes, (this was a couple years ago) and he was completely unaware, and thought it would be considered a moped (I was riding a pedal bike at the time) but there is quite a bit of E-Bikes around this area now, so I imagine there wouldn't be a similar problem here.

Now that I think about it, it was interesting, as well, because he didn't even ask to look in my front basket (There was a LOT of stuff/bags in it (My tools and various bicycle parts) or in my back (enclosed) box that holds my batteries and various accessories... About 50% of the time they ask me what's in there, and I just tell them the above... Only once or twice did anyone ever look (and of course find what I said).

You DO know, that it was NOT a "story", it's an (as best of my ability to be accurate) account of what happened to me on Saturday afternoon..

There is no reason (for me) to have a "stealth" ebike as ANY ebike (that conforms to the legal definition of one) is perfectly allowed to use the roads (under power or pedaling) or the sidewalk (pedaling only and only if there is no local ordinance that specifically forbids pedal bicycle riding on a sidewalk) just like any other regular bicycle..

There is a state law, specifically stating as such... And for anyone to tell me, I'm not allowed to do something when it's perfectly legal to do so, they can just leave me alone or I will just hire counsel and let the law be on MY side!
 
Definitely a good thing that cop doesn't live in your town, making you deal with him daily.

I lived with a target on my back for years. Did several juvie probations before it ended. Cops used to get a great big smile when a they saw my name on the licence even years later. Then would come tickets for everything possible. Warnings? :lol: My juvie busts were well attended, pretty much the entire force would arrive just to see me in cuffs.

Lots of unpleasant stuff resulted from all this, I was only ten years old when the cops declared war on my family. The opening salvo was they euthanized my first dog in 1968. Then plenty of other codes enforcement stuff etc. It sucked for a good 15 years to have the local cops hate your guts. A lot of cops had to retire before it eased off.

The other thing was, he had someone (Another gentleman) with him (plain clothes) and a second (female) officer also showed up in a cruiser.. I think that the other two people there, were definitely subordinate as they seemed quite confused that he actually let me go, when supposedly I was doing something so "incredibly wrong" by not having "a tag" and riding so illegally (as the Ofc TRIED to make it seem)...

(It was even more apparent to me, when I saw them later in the evening, and the female officer queried to the officer that pulled me over originally, "Doesn't he need a tag for that?" (I heard that as I was pulling away, after getting the officer's business card.)

At one time a local cop (in NJ) was really "interested" in my sister.. She was already dating someone and had no interest in this guy... Well this guy would harass my sister all the time (kept trying to ask her out) and would have his son (TRY) to bully me into getting my sister to date his dad. We would be pulled over constantly for no reason, etc..

After about a month of that i finally got fed up and I walked right into the police station, spoke directly with the commander and amazingly all the harassment stopped..

Trust me, elected officials (most chief of police and local law enforcement commanders) don't like to hear about their subordinates doing things that might jeopardize their status with the community and / or their jobs.

I'll wait until tomorrow afternoon and if I don't receive a response by then, I'll directly call the Police Chief and if nothing changes, I'll send out some certified letters to the Town Council, Mayor, Sherriff's office, State police and the State AG's office..

Emails and phone calls will start to become abundant, as I wish this to be "rectified" as quickly as possible..

After that, and no responses, I guess I'll have to start "lawyering up"!

I suspect you'll be doing a lot of writing and calling until you start "lawyering up". Take the time to write a short succinct letter to each person you have mentioned, and I am sure you will get a more positive response. I am not picking on you, or your English. I genuinely want you to succeed in your endeavors of raising awareness of the legitimacy of electric bikes anywhere - even if I don't live in Florida.

Why take the time to write a short letter? Well, to quote some famous people:

You have to remember - the police department, the ombudsman (or equivalent), and Ministers of Parliament receive thousands of emails a day - most of them would be from real criminals who felt they have done nothing wrong and many will even be just vindictive letters trying to get a police officer in trouble. (Recently an Islamic woman who was pulled over for not displaying a provisional licence plate, accused a police office of trying to pull off her veil. In car video showed that 1. She wasn't displaying a P-plate, and 2 - There was no action that could have reasonably been construed to be an attempt to remove her veil). The vast majority of the complaints will be written in the same format as you've written yours - in a story format. Stand out. Make your one professional and short. People are more likely to sit up and listen.
 
When a dog is barking at you, best is to ignore or laugh at him. Confrontation is more time consuming than rewarding.

Officer: -Why are you laughing, you find this funny?

Me: - Not this, but you. Sorry, I just can't refrain myself.

Officer: - I'm gonna give you a ticket, you won't find it so funny.

Me: - Please do, I want a souvenir, and a proof for the story I'm gonna tell all my friends.

Officer: - This is disrespect to an officer of the law.

Me: -The law says I can't hit you, but nothing about laughing.

Officer: - Are you making fun at me?

Me: - I don't need to. Let's make a deal: You stop your show, and I stop laughing.

Officer: - You're a clown, aren't you?

Me: - Don't reverse the roles
 
Good luck with your situation. One approach might be to get a local paper to do a story about ebikes. Feature your bike, and how it complies with the florida law.

Clearly the cops have never heard of a vehicle with a motor that is not a motor vehicle. There are a shitload of obsucre statutes in any motor vehicle code.

My situation was quite different from yours, I just meant it as an example of how bad things can get. My older brothers were doing illegal stuff, and so was I when I got older. Mom was keeping the cops off our back by threatening a huge lawsuit over a warrantless search of our house.

But then mom remairried and moved to Texas. Perhaps I should have gone with her. Suddenly we were naked, and the cops had not forgotten anything. Bros were gone by then, so I got all the heat later. I was at least smart enough to stop when I turned 18.

Just saying, file a suit make sure it's a real good one. The cop only talked to you, I don't see the damage here.
 
Cops don't really know the law they go buy rough guidelines and then look up the law later.
